What is probation before judgment?

Certain people, who have had a clean driving record for the last five years, may be eligible for a program that helps keep your driving record clean. The probation before judgment program works like this:

  • You will enter a plea of 'guilty' or 'no contest' to the charge.
  • The court will defer any further action and the entry of judgment on your record
  • The court will place you on probation for a certain period, placing additional conditions on your probation
  • If you complete the terms of your probation no judgment will be entered on your record.

Who is eligible for probation before judgment?

To be eligible for probation before judgment you must have been charged with a misdemeanor driving offense — DUI charges and drug related charges excluded. You must not have been on probation, on parole, in a state of incarceration, or involved in any other early type of release. You must not have entered the program anytime within the last five years. You must not have been convicted of any of statutorily listed offenses — for example leaving the scene of an accident or reckless driving.
